Sofia Vergara Shares Frustration Over Frozen Embryo Battle With Ex-Fiancé Nick Loeb

Sofia Vergara is opening up for the first time over the frozen embryo battle with her former fiancé Nick Loeb.

I'm not going through anything. He's going through it," said Sofia Vergara to Howard Stern on Tuesday during an interview with the SiriusXM radio show host.

The sexy Modern Family star is currently in a legal battle with her ex, Nick Loeb over her frozen embryos.

Loeb filed a lawsuit to prevent the 42-year-old actress from destroying two female frozen embryos that they had conceived through in vitro fertilization when they were together.

In a recent op-ed in the New York Times published last week, Nick Loeb wrote that keeping the embryos "frozen forever is tantamount to killing them." Even though they are not together anymore, he said he would like to try to bring the embryos to term and "take full parenting responsibilities."

"I don't hate him but obviously he has a problem with me," said Vergara, explaining that they signed a contract about this in 2013. And they've been split for a year now.

"A kid needs parents. I would't imagine anyone saying it's sane to bring in the world already everything set up wrong for them. It would be so selfish."

"I totally understand him," said Vergara, adding, "Fortunately or unfortunately, there is law. You signed legal papers. If it was serious for him, this issue - which I totally respect is for someone - he should have taken it more seriously. There is a contract."

Vergara is currently engaged to "Magic Mike" star Joe Manganiello. During the interview with Howard Stern, she was clearly happier discussing her new relationship than the lawsuit.

Manganiello proposed to her while in Hawaii on Dec. 24. She was in her pajamas getting ready for dinner. They've been together 10 months, engaged for four.

Stern focused on her 7-carat engagement ring. "Is that worth over $100,000 that thing?'

"Si!" she said.
