Kim Kardashian And Kanye West Update: Couple Given Permission to Sue Youtube Co-Founder for Leaked Engagement Videos
Kim Kardashian and Kanye West have been allowed to proceed with their intention to sue Youtube co-founder Chad Hurley for alleged unlawful uploading a video showing the engagement of the reality TV couple in 2013 in his personal-owned website, Mix Bit.
According to Rollingstone, the tech executive was at the AT&T Park in October 2013 to witness the rapper's proposal 'snuck into the park' to film the proposal.
Hurley is made to sign a non-disclosure agreement that no videos about the proposal will be leaked anywhere. Photos of the Youtube executive signing the legal document have also been taken.
However, as Billboard said, Hurley interpreted the contract as something that only applies to Youtube but not to his new website, Mix Bit.
The couple's lawyer also learned that Hurley used the video to raise visibility of his new site which is reportedly not earning well.
"Hurley's new venture, MixBit, was not doing well, he posted the video on MixBit, which provided it with significant publicity, and he did so within hours of leaving the event. A jury may reasonably infer fraudulent intent from these circumstances," the opinion states.
In response to the lawsuit, Hurley's lawyers tried to appeal to a Los Angeles judge with his lawyer, Rodger Cole citing his client's right for free speech rights in posting the video, ABC News said.
However, the California appeals court did not entertain Hurley's appeal and had decided that Kim and Kanye's lawsuit should proceed.
The said 2 ½ minute video contains memorable scenes from West's engagement at San Francisco AT&T Park. In the video, one can see a rendition of the Chicago Symphony with a Jumbotron message saying "PLEEEASE MARRY MEEE!!!"
The video is supposed to be one of the highlights of the upcoming season of Keeping Up With the Kardashians.
