'Modern Family' Star Sofia Vergara Sued For Her Frozen Embryos; Ex-Fiancé Nick Loeb Fights For Custody
The legal battle between Modern Family Sofia Vergara and her ex-fiancé Nick Loeb over her frozen embryos is still not over. On Tuesday, a right-to-live lawsuit was reportedly filed against the actress. The legal battle is for the protection of the embryos.
Court papers that were filed in Louisiana list the embryos as Isabella and Emma. The alleged suit asks that Loeb will be given full custody of the fertilized eggs so that he can have them implanted in a surrogate. In response,
Vergara's lawyers issued a statement, saying that the judge presiding over the case was to rule on her request for sanctions against Mr. Loeb for refusing to comply with a court order. They also added that Vergara's motion for summary judgment-seeking dismissal of the case he filed against her was also issued in the statement.
They also noted reports of Mr. Loeb filed on behalf of the pre-embryos in Louisiana after trying to get the relief that he was trying to get through his failed legal attempt in California. The statement also claimed that the media report Mr. Loeb has caused a lawsuit to be initiated claiming that the pre-embryos have been given names by him and have a right to live.
They also said that it is unfortunate for Loeb for continuously linking himself to Vergara, who is married to Joe Manganiello, by taking up more of our court's resources, preventing judges from focusing on real legal problems.
The 41-year-old entrepreneur sued the 44-year-old actress last 2013 over the embryos they created when they were still engaged. He penned in his op-ed in New York Times his plan to become a single father.
Vergara said in an interview they have signed an agreement last November 2013, stating that neither would use the embryos without the consent of the other side. However, the new alleged lawsuit shows that the contract should be voided because it violated Louisiana law and California code.
